Statutory nuisance
The Environmental Protection Act 1990 gives the council the
power to investigate complaints of nuisance, and to take action if
we are satisfied that the matter is a statutory nuisance.
Statutory Nuisances are specific nuisances as defined by this
law, and if proven the matter is a criminal offence. Statutory
nuisance is generally defined as unreasonable and significant, and
as having an unreasonable affect on a persons enjoyment of their
property, it is much more than just an annoyance or being aware of
something.
The Environmental Protection Unit can investigate a number of
issues in relation to statutory nuisance, and as such have produced
a range of advice leaflets (which are available to download from
the related documents section below). These explain the law and
give some suggestions to help prevent causing a nuisance.
